    THE SUBJECT ORDER WAS ISSUED ON AN EMERGENCY BASIS BECAUSE BILLY FULLER, A FEDERAL PRISONER IN THE CUSTODY OF THE USMS, HAS BECOME ILL OR INJURED AND REQUIRES IMMEDIATE MEDICAL CARE IN ORDER TO PROTECT HEALTH, LIFE, LIMB, EYESIGHT, OR HEARING. THE PRISONER IS BEING TRANSPORTED TO ALASKA REGIONAL HOSPITAL BY DEPARTMENT OF CORRECTIONS (DOC) ON OR ABOUT 1530 ON MARCH 14, 2012 FOR TREATMENT OF ABDOMINAL PAINS. THIS HOSPITAL WAS CHOSEN BECAUSE IT IS THE CLOSEST HOSPITAL. THE CLOSEST HOSPITAL WAS NECESSARY IN ORDER TO PROTECT THE HEALTH OF THE PRISONER. AROUND 1930, INMATE FULLER WAS ADMITTED TO THE HOSPITAL FOR SURGERY TO REMOVE HIS INFLAMED GALL BLADDER REQUIRING AROUND THE CLOCK GUARD SERVICES. SECURITAS SECURITY SERVICES WAS CONTACTED TO GUARD THE PRISONER DURING THE PRISONER S EXTENDED STAY IN THE HOSPITAL PER USMS POLICY 9.3, PRISONER OPERATIONS. BASED ON THE ABOVE DESCRIBED SITUATION, THE FOLLOWING DETERMINATIONS ARE HEREBY MADE: SET-ASIDE DETERMINATION - THIS ACQUISITION WAS NOT SET-ASIDE FOR SMALL BUSINESS CONCERNS BECAUSE AS INDICATED ABOVE, THE PRISONER REQUIRES EMERGENCY MEDICAL TREATMENT AND IS BEING TAKEN TO THE CLOSEST HOSPITAL. THEREFORE, IN ACCORDANCE WITH FAR 19.502-2, THERE IS NO REASONABLE OPPORTUNITY TO OBTAIN COMPETITIVE QUOTATIONS, AND NO REASONABLE EXPECTATION THAT AT LEAST 2 COMPETITIVE QUOTATIONS WOULD BE RECEIVED FROM AT LEAST 2 SMALL BUSINESSES CONCERNS. COMPETITION - THE PURCHASE ORDER IS BEING ISSUED ON A SOLE SOURCE BASIS BECAUSE IT IS MEDICALLY NECESSARY THAT THE PRISONER BE ADMITTED TO THE HOSPITAL FOR MEDICAL TREATMENT AND REQUIRES AROUND THE CLOCK MONITORING. ANY DELAYS INCIDENT TO COMPETITION COULD JEOPARDIZE THE HEALTH OR LIFE OF THE PRISONER. THEREFORE, IN ACCORDANCE WITH FAR 13.106-1(B), THE URGENCY OF NEED DEEMS ONLY 1 SOURCE REASONABLY AVAILABLE. THIS VENDOR HAS PERFORMED THIS SERVICE IN THE PAST SUCCESSFULLY. THEY ARE TRAINED AND EXPERIENCED WITH USMS POLICY AND REQUIREMENTS.
